Our Services Also Provide a Marketplace: Our services also offer a marketplace where Users can buy and sell design items, such as fonts, brushes, patterns, and other digital assets (“Assets”). Some of our services allow a buyer (“Buyer”) to acquire limited licenses (as per the Applicable License) to use Assets from stores opened on the Services by independent creators (“Store Owners”). References to “buy” or “acquire” Assets mean buying or acquiring limited licenses for these Assets.

Eligibility: You can only use the Service if you can enter into a binding contract with us and only in compliance with these Terms and all applicable local, state, provincial, national, and international laws, rules, and regulations. The use or access to the Service by anyone under 13 is strictly prohibited and violates these Terms. The Service is not available to any User previously removed from the Service by Pixly.Design.

License Terms: As mentioned above, the use of any Asset is subject to the Applicable License (described in the License Terms and Font License Terms). We and the Store Owners offer different types of licenses, so it’s important that you carefully review the rights and restrictions of the License that applies to the Assets before acquiring a license for such Assets. In the event of a conflict between the License applicable to you and these Terms, the License shall prevail to the extent of the conflict.

Our Services: Subject to the terms and conditions of these Terms, you are hereby granted a non-exclusive, limited, non-transferable, and freely revocable license to use the Services solely for your use, as permitted by the functionalities of the Service and by these Terms. Pixly.Design reserves all rights not expressly granted in the Services and the Content (as defined below). Pixly.Design may revoke this right at any time, for any reason or no reason.

Your Account: Your account gives access to the services and features that we may establish, maintain, and modify from time to time and at our sole discretion. We may maintain different types of accounts for different types of Users (e.g., Store Owners, Affiliates, Pixly.Design Pro, Pixly.Design Pro Business), which may provide access to additional or different features of these Services. By connecting to the Services with a third-party service (e.g., through your Facebook or Google account), you give us permission to access and use your information from that service, as permitted by that service, and to store your login credentials for that service. You are responsible for tracking all activities on your own account and agree to the following: Safeguard all passwords and usernames securely. Notify us about any unauthorized use or security breach. We will not be liable for any liability, damage, cost, loss, or expense caused by or related to any unauthorized use of your account. Never share login details or account access with anyone, including clients or team members, unless explicitly allowed by additional terms applicable to your account type. Accept responsibility for activities that occur under your account(s). Never transfer, rent, “sell” or make available your account to another person.

Monitoring and Enforcement: Termination. Pixly.Design reserves the right to monitor downloads and user activity to ensure compliance with the terms of these Terms and the Applicable License, which we may update from time to time, at our sole discretion. We further reserve the right to monitor downloads and user activity for the security of our Services, fraud detection, and protection of our Users and to ensure compliance with applicable laws. We may, without prior notice, change the Service, stop providing the Service or features of the Service, or create usage limits for the Service. We may terminate or suspend your access to the Service permanently or temporarily without prior notice or liability for any reason, including if, in our sole discretion, you violate any provision of these Terms, or for no reason at all. We may remove or refuse to post any User Content (defined below) for any reason or no reason at all, at our sole discretion. We will not be liable for any loss or corruption of User Content that you provide to the Services. After termination, for any reason or no reason at all, you will continue to be bound by these Terms.

Cancellation and Refund: At Pixly.Design, we want to ensure that our customers are fully satisfied with the products they purchase on our platform. Therefore, we offer a refund and return policy with a deadline of up to 7 days from the date of purchase, provided that the purchased files have not been downloaded.

If you are not satisfied with your purchase and have not downloaded the files, you can request a refund by contacting our customer support within the 7-day period. To be eligible for a refund, the product must be in its original and unused condition, and you will need to provide proof of purchase.

We reserve the right to refuse refund requests in case of violation of our Acceptable Use Policy.

Refund request process:

• Contact customer support within 7 days from the date of purchase.
• Provide proof of purchase and the reason for the refund request.
• We will evaluate the request individually and may request more information or documentation to process the refund.
• If the refund request is approved, the full purchase amount will be refunded.

Products not eligible for a refund:

• Physical products that have already been used, opened, or damaged.

• The refund will be processed within 7 business days after the approval of the refund request.

Cancellations: If you wish to cancel an order before it has been completed or before downloading the product, please contact our customer support as soon as possible. If the product has not been downloaded, we will process the cancellation and refund the full purchase amount.
